Cloud data 'is still firm's responsibility'

British businesses that have subscribed to could computing technology providers in a bid to manage their IT spend have been advised that they remain legally responsible for the data that is stored.

International law firm, Pinsent Masons has warned that although data is stored by the cloud provider, the businesses will still be accountable for it.

Tom Greenbank, the firm's solicitor in outsourcing, technology and commercial, explained that it was unlikely that smaller enterprises would be able to force the hand of large cloud providers to amend the assurance arrangements.

"If you try to negotiate these terms [of assurance], the response from the likes of Amazon or Google will be 'no, this is our model – if you amend our terms then we can't deliver the service'," he said.

"Unless it has been agreed in the contract, the general position is that the customer is responsible."

The comments were made earlier this week at the Westminster eForum keynote seminar on cloud computing.
