Company fined over health and safety compliance failures

A firm which failed to comply with health and safety laws has been issued a fine of £65,000.

Cumbrian Industrials pleaded guilty to breaching Section 3(1) of the Health and Safety at Work Act 1974 for failing to ensure the safety of members of the public.

The prosecution came after a motorist hit the vehicle of contractor working for the firm which was unlit and situated on the hard shoulder of the M6 near Carnforth in north Lancashire. The driver died as a result of his injuries.

Commenting on the case, Health and Safety Executive principal inspector Joy Jones said: "Roadworks always need to be managed with great care to ensure the safety of both construction workers and road users. There should be clear signing and a consistent use of traffic cones."

She added that Cumbrian Industrials should have carefully planned and coordinated the work conducted by its subcontractors in order to prevent such accidents occurring.
